Introduction

Welcome to Halal Spotz, a mobile application ("App") developed and managed by Zagobi LLC ("we", "us", or "our"). Our App provides lists of restaurants relative to your location, allowing you to scroll through these lists, save and bookmark restaurants, and access a map with markers indicating nearby restaurants. By accessing or using the App, you ("User", "you", or "your") agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of the terms, you may not access the App.

Use License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on a mobile device owned or otherwise controlled by you.

Accounts and User Conduct

Account Creation: You must provide accurate, complete, and current information when creating your account. Failure to do so constitutes a breach of the Terms, which may result in the termination of your account.
User Conduct: You agree to use the App in compliance with all applicable laws and regulations. You shall not exploit the app for any unauthorized commercial purposes. Misuse of the App may result in termination of your account.
Features and Services

• Restaurant Listings and Bookmarking: Users can scroll through restaurant listings, save, and bookmark their favorite restaurants for easy access.
• Map and Location Services: Access to your location is used to display a map with markers indicating nearby restaurants. You can disable location services in your device settings.
• Restaurant Recommendations: Users can recommend restaurants to be added to the App via an external form.
• Recommendations are reviewed by Zagobi, and we reserve the right to decide whether to add the recommended restaurant.
• Feedback: Users can provide feedback about the App through an external form. All feedback will be reviewed internally.
• Account Deletion: Users have the option to delete their accounts at any time.
• Sponsoring Restaurants: Users have the option to sponsor restaurants of their choosing, subject to a certain fee.
  Content and Intellectual Property
• Users will not have the ability to upload content to the App. All content available on the App, including but not limited to text, graphics, logos, and images, are the property of Zagobi LLC or its content suppliers and protected by copyright and other intellectual property laws.

Termination

We may terminate or suspend access to our App immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Zagobi LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your access to or use of, or inability to access or use the App.

Without limiting the generality of the foregoing, Zagobi LLC assumes no responsibility for, and shall not be liable for:

• Any errors, mistakes, or inaccuracies of content displayed on the App, including any errors in restaurant locations, descriptions, or availability.
• Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our App.
• Any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
• Any interruption or cessation of transmission to or from the App.
• Any bugs, viruses, trojan horses, or the like which may be transmitted to or through our App by any third party.
• Any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App.
• The defamatory, offensive, or illegal conduct of any user or third party.

In jurisdictions that do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such jurisdictions, Zagobi LLC's liability shall be limited to the extent permitted by law.

User Acknowledgment

You specifically acknowledge that Zagobi LLC shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

Indemnification

You agree to defend, indemnify, and hold harmless Zagobi LLC, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: your use of and access to the App; your violation of any term of these Terms of Use; any claim that your actions affected a third party; or any claim arising from your negligence or more culpable conduct, or arising from your violation of applicable laws.

This section does not affect any liability which cannot be excluded or limited under applicable law.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the state of Texas, without regard to its conflict of law provisions.

Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide at least 30 days' notice before any new terms take effect.
